Legal Notice:  Artwork Licensing

**All Artwork remains the property of Exceleron Sports unless specified under section 2 below**

All artwork, digitizing, layouts, and designs that are created for your orders are the property of Exceleron Sports.  Any charges you will incur or have already incured for artwork or digitizing, is for the time spent on the artwork and does not give you, the customer, ownership of this artwork nor does it include the licensing for the artwork itself.  Licensing and ownership of your design(s) remain held by Exceleron Sports, but can be purchased for a fee of $150.00 per design.

If a license in not purchased, Exceleron Sports will only provide a very low resolution rasterized JPG image upon a request of a copy of the artwork.  If your artwork needs to be used for other projects that you are not contracting Exceleron Sports to do and they require higher resolution graphics or vectorized (line art) files; you will need to purchase the ownership & licensing of the design, or request that your alternate contact/company recreate the artwork for you at their recreation fees.

All artwork, layouts, designs, and digitizing are Copyright © Exceleron Sports 2008 under the United States Copyright Laws of prior use.  Reproduction without written consent will be prosecuted to the fullest extent of the law.

Section 2:  Notice to Copyright Owners

All orders completed by Exceleron Sports require the acceptance by our customer of our copyright waiver.  Please read on for details...

All orders placed and created by Exceleron Sports are done on a "by demand" basis.  Meaning the customer, has requested that we complete the order with the artwork specifications that they have provided to use.  Customers are required to physically sign (or digitally sign with a secure username and password) a copyright waiver stating that they: a.)  own the copyright to a specific logo, b.)  that they have researched all the logos and elements that they have requested us to use and determined that there is no other copyright holder, and c.)  that they will take full responsibility for any copyright infringement that has occurred in respects to their order.  In this regards, Exceleron Sports agrees that it will not claim copyright ownership, and will cooperatively furnish all copyright waiver documents, including the customer's name and contact information (upon legal request) to the original copyright owner, so that the customer may be held accountable for their actions.  Upon learning of such infringement, Exceleron Sports will immediately dispose of all files used that are in violation, and add the elements to our restricted elements listing so that they will never be used on future orders by any customer, except the original copyright holder.  If a licensing fee ($150.00) has been paid by the customer to Exceleron Sports, the fee will be given to the original copyright holder (pro rated, if only portions of the licensed design are under copyright).  Any other artwork fees or digitizing fees will be retained by Exceleron Sports, as these fees are a payment towards the time spent by our artists to create the artwork as requested by the customer.  Any other infringement damages (other than the licensing/ownership fee of $150.00) should be directed towards the customer, who has accepted full responsibility for any copyright infringement damages.  The customer has accepted all damages, including, but not limited to, attorneys fees, court costs, damages created by the use of the copyright material, etc.

Exceleron Sports is not in the business of researching copyright holders and all customers are informed, warned, and agree that they will take full responsibility for any copyright infringements.  If you feel an infringement has occurred, please email Customer-Service@ExceleronSports.com and we will gladly cooperate with your operations to see that the protection of your copyright can be upheld.
